would be legal if some one would colect donations for him self....but he wouldn't say that he colects them for him self he would say that this is for kids or operation....to save his life.. ? how could I proove this and what punishment that person could get?

Besides criminal fraud he's guilty of IRS tax law violations for pretending to be a charity if he told people the money was going to a non-profit.

We had a guy here who not too long ago put out the donation cans at all the local businesses saying his niece needed an operation. (She really did, that wasn't a lie.) In reality he was taking all the money. The family found out when someone called them to verify and I think the dad of the little girl beat the guy to an inch of his life and got the money back. Sometimes there's ways to administer justice without getting the authorities involved... :)

It can actually be considered obtaining money under false pretenses. And depending on the amount of money collected, you can face criminal misdemeanor or felony charges. Not sure what state you are in, but check with the prosecuting attorney's office on what the laws are on this. In my state it is illegal to do because it's really hard to prove if that money is going to what it's supposed to. You see these money jars on counters in just about every store. Some are valid as others aren't. And some do eventually get caught. It's fraud, plain and simple. Just check on your state laws.

This person is still collecting under fraud. They are miss leading the people who would be donors. I don't know what the penalty would be. That would be for a court of law to decide.

No that would be illegal and he could be brought up on FRAUD charges theft by deception ....To prove it you would need a few of his benefactors to testify or sign an affidavit stating he was collecting money for an operation etc.

that would be fraud the punishment would depend on the state your in and the amount of money you stole with your deceit.
