I have this 54 year old man living in my basement not paying any rent .Everytime I go to court he always say he needs more time.This has been going on since April.2006. The last time i received rent from this man was in March. Now he is living rent free. What should i do i live in NYC. He received two extentions ,how many can the court grant him before his a** have to get out of my house.

Cut his electric off or throw bleach first and then ammonia under his door. The poison gas would disturb him. Eh, but that would be illegal.

Have you given him a written notice of eviction? If not, you need to give a 30 day notice and then after the 30 days, if he's still not out, you have to go back to the court to get a court order to have him removed. The police generally have to be present when someone is made to leave the property and will usually serve the order to vacate. If he has health problems, etc. then the courts may even continue to grant him extensions for up to a year! It's not fair, I know, but it happens. Families with small children are able to get extensions like this also. Good luck! Hope things work out soon because I know it's very frustrating. And although it sounds tempting, if you are the landlord, you can not interrupt any of his services such as heat, electric, and water if you are supplying them.

DO NOT follow any of the self help suggestions you are getting in this forum. NY has very strict tenant protection laws & a whole sub-culture of lawyers who make a living suing landlords. For NYC an eviction lasting 6 mos. is not unheard of. Follow the legal procedures & sooner or later the Court will order him out. It may move a lot faster if you retain an attorney.

You don't say, but it sounds as if you are trying to get this through the courts without legal representation. I know that a lawyer can cost you, but you are losing money every month this guy stays. And you can figure you will never see any back-rent paid once you are freed of him.

So, look up a lawyer that specializes in real estate matters and have them do the necessary steps to get this guy out. Once you get the courts or other means to legitimately evict him, then you can call on the police to escort him out if he won't leave. That's when you change the locks.

Start playing your stereo loudly at 3AM for starters: ) Seriously, though you could stop things from working that r considered luxuries and not necessities, like AC, dishwasher. cable TV , etc. Or If he tries 4 another extension claim to the court that it's a financial hardship for u to pay bills, mortgage, etc.

Call the cops and have them give him an eviction notice. He'll have 30 days to get the hell out. And keep pestering the courts.
