wife has a workman's comp case. it is involved in the settlement. i need to know how to put this money (if she gets it) into escrow until the divorce is over/final.

If the workman's comp is already involved in the settlement, then you don't need to worry about it. Re-read the fine print on your temporary order. Neither one of you can dispose of any assets, bank accounts of forms of income between now and the final judgement of divorce.

I'm not exactly sure why you would be entitled to any of this, but if it's stipulated, she can't spend it...at least not your half without some major consequences through family court.

First of all, find out if the Workman's' comp is subject to income taxes or not. I have a feeling it is. If it isn't, then it can't be subject to child support (check your state laws to find out for sure). Also, if it is your wife's money, you have no legal grounds to put that money into escrow. Check and see if your state is what they consider a community property state. What that means is that any assets or debt accumulated during the period of marriage is jointly owned by both parties unless there is a pre-nuptial agreement or court-order or binding legal contract stating differently.

I would check with your divorce attorney for advice. Also, get a record of such settlements and any/all other assets the two of you have. The court will divide these assets in the divorce. In my divorce, she got the goldmine and I got the shaft!!! LOL
