He never takes her home at night he does play with her but never takes her home, making rediculous excuses. Is it illegal?

No. It's only illegal to abandon them, or leave them with someone who you know will not care for them.

Because the parent is leaving the child in the supervision of a responsible adult he is not doing anything illegal. The better question is what do you hope to accomplish?

Are you looking to force the parent to be responsible? While I won't say it can't happen you have to look at the possible repercussions of this action. If the parent is unlikely to push the child off on the grandparents, a responsible set of adults to care for her, he will likely find an irresponsible adult to care for her or based on the child's age leave her alone.

Are the grandparents or another adult seeking guardianship? I would ask the father discretely if he is open to that possibility. If he is not and you are willing to fight for custody make sure you document everything and then hire a good lawyer.

If the grandparents are simply tired of taking care of the child and want to be rid of the responsibility, then calling children's services may well cause the child to be taken away. However, the child would then likely be placed into foster care and you have no control over the type of care the child would receive then. While most foster homes are good, not all are and you have no control over the child's fate once she is placed in the state's custody. But try as they might courts can not force parents to be responsible. It is a choice they have to make on their own.

Legally, it is not unless the grandparents are knowingly abusive and the parent is intentionally putting the child in harm's way. As long as the grandparents' are willing to care for the kid, then the child is considered "cared for". If the grandparents had a problem with this, they should speak with their daughter and demand that she take a more active and responsible role in raising her own daughter. If they are worried that their daughter would take her child away and neglect her elsewhere, then they could file a report with the department of child services or petition to take custody of their grandchild, if the case is strong enough.

Having said that, this is definitely a question of morals. Is it right to do what she's doing? In most people's eyes, I would think not. Without knowing the particulars of this situation, it would be difficult to say. If she's a single mom working two or three jobs, I can see why she is doing what she is doing. Maybe she's dating and trying to find a man to be a father to this child...we don't know, so it's difficult to make a judgement. On the surface, though, it doesn't seem morally right. She brought this child into the world, and she should take responsibility for her actions.

Sadly, it's NOT illegal, but IMO, definitely immoral and even cruel. How old is this "parent"? He's not acting like one. If it continues, the grandparents could have a good case in a custody suit. But, that's if they WANT custody! I'd get the Dept. of Children, or whatever it's called, involved, to TRY to help this guy take responsibility!

Is this the mother posting? Where does she fit in? The only permanent solution to this problem is good sex education and available birth control! Everyone should contact NARAL and urge their representatives to make this a priority, so there are no unwanted kids.

If the grandparents wanted to raise the kid without the parent then there would be grounds in court, but not for anyone outside the family.

No, it is not illegal. Maybe it is for the best that he takes her to his parents, even though he should be responsible.

Legally it's okay. Morally, it is wrong. Hopefully this person will grow up before their child does and get some responsibility.
