I think it depends on what state you are in. The state i am in is community property and would have to fight for the house if i were in the same situation.

When you had it refinanced and added his name to the mortgage you legally made him co-owner. Not only does that give him equal rights to the property - it also makes him equally responsible for the payments. If you were to divorce you would have to treat it as joint property. Whether you "fight" him for it would depend on what you work out in your divorce settlement. There are several options available regarding the dissolution of the property that your lawyer should explain.

If you can prove the amount you put into the house before married you most likely will get your share. Putting both names on it will make it harder to prove.

If he is helping since you refinanced he has a share in it from that time forward.

You'll probably have to fight for it. My wife's name is no where on the legal documents of my house. It doesn't matter. Once you are married, in most states, .. after the marriage takes place.. it is pretty much 50/50. Get a good attorney and discuss your options. Good luck !

Well that may depend on how long you have been married and hoe long you had the house before you were married. If you have been married over 3 years try to be nice and try to get him to let you have it.See if you can get him to sigh a quit clam deed as soon as you can. That will turn it all back over to you ask your attorney about one he will have to file it for you.

You may have fight for it hope not good luck!!

If you divorced he is intitled to half the proceeds of the sale of the house according to community property laws. He is responcible for the payment and therefore intitled to the profits.

Depending on what type of person he is, you might have to fight for it or just pay him out.
