My friend has a job that requires him to carpool, that's a good thing... Now that this person is carpooling one of the other persons in the car has decided to smoke pot on their way home from work every night... The owner of the car doesn't think it's such a big deal even though he knows my friend is on probation and if they were to get stopped by police and drugs were found might send my friend to prison by violating his probation. There is no other means of transportation for him to take and he asked me what he should do. He's also required to maintain a job. I need input as to should he confront the carpool operator, quit the job, take a chance and go on riding or ???

there is no other carpool available due to this being a job in a very rural area an hour away from his home town.

He needs to be honest and up front with the pot smoker, and just say wait till ya get home buddy, its not worth me doing time. If nothing changes they outta speak to the operator and explain his predicament. better to speak up than be locked up!

I think he should immediately quit the carpool because he is taking a huge risk.

I sat on a jury once where a car with 4 young men was stopped on the interstate. The trooper testified that before he got to the car the widows were rolled down and he could see as well as smell marijuana smoke. The vehicle was searched and on the passenger side on the floor an empty paper cup from a fast food place had a bag of pot in it. They also found a few seeds and leaves on the floor of the vehicle. Unfortunately one of the people in the vehicle owned the pot, but they all went to jail for it. And that's a true story.

It's just not worth the risk. If he makes an effort, I'm sure he can find another means to commute.

This is a very akward position. He should really sit down and have a good chat to the smoker as well as the owner of the car. Be honest with them and explain your situation with them. I would suggest he goes out of his way to try and find another lift to work.

Not sure how his relationship with his employer is but he might even go there for help.

I am sorry If i am asking stupid questions but I am not sure how the system works. Is he being monitored by a parole officer or someone else. Be honest with this person and ask his/her advice.
This is going to be difficult but he will have to get out of this situation.
It is not worth his freedom and future to have to sit up with this.

Because of your friends probation status, he is going to HAVE to stop riding with these people, unless he wants to risk a 6month stretch for violation. I understand that he is caught between a rock and hard place, but....if he continues this, he'll be screwed if he gets caught. Not worth it.

First he should speak to the car owner he could claim to have a health issue and say smoke bothers him. He could also contact the police and give the information needed and be a law abiding citizen.

If I had to drive myself everyday to be able to stay out of trouble, I'd be on my way to and from work with a smile on my face because I'm free and you probably know, that until you have your freedom taken away from you, you really don't know what the word freedom means and it means alot, until it's gone, Trust someone with a little experience, it's not worth it, nothing is.

Not a good ideal, I agree with you, and anyway who chooses to continue to smoke pot, that's really lame...In some states they can take the car, and if a drug test is taken with hair, trace evidence of marijuana could show a positive result...
