to let his 17.5 year old friend, who is still in high school rent our apartment because I moved back with my mother. The thing is. The lease states that only he and I can inhabit the apartment. In Texas (our state) the lease law is 18. I am currently still paying my share of the rent. Is this legal, or possible? Can I fight/prevent his friend from coming and living in the apartment?

Since you are one of the lessees, you have 1/2 of the say about what goes on in there. The thing to be careful about is the fact that if something goes wrong, you could end up with 100% of the liability. Don't let that happen to you! Tell him no, and then tell the owner of the property.

The only way this would be legal is if you two were allowed to sub-let and if the friend were an emancipated minor. It doesn't sound from your details like either is the case.

You do not have to allow the friend to move in. Keep in mind that since your name is on the lease, anything that happens in that apartment can come back and bite you in the rear end. You can prevent the friend from moving in simply by going to the landlord or leasing company and telling them what is going on. Tell them that you are still honoring your part of the lease by contributing your money, and that your BF wants to let someone else in. They should be able to help you with the problem.

Tell the landlord.

As long as you're paying your rent, and fulfilling the lease, it shouldn't matter to the landlord if you're actually there or not.

Especially if you are still on the lease, and there is no record of this 17.5 year old friend living there, you don't want to leave yourself responsible for damages or anything else.

I'm not from Texas, so I am not certain if you can get out of the lease if you find a renter, as in, the kid could take over your obligations.

But definitely, I would make sure the landlord knew about all of this.

If you are on the lease and paying rent, then you have a voice. If the friend moves in, the apartment complex can not legally get rent from him unless he is on the lease. But that does not prevent him from giving money to your boy friend to pay his half of the rent. The apartment complex may not allow him to live there if he is not on the lease. Your guest may stay for a few days, but then there is a period of time that it is not right. Talk to the apartment manager and maybe a person at the Texas apartment renters association to get an idea of what your options are.

as far as i know i dont live in Texas if your name is on the lease you are totally responsible for the apartment in til your leases expire so if you let any one move in and what never damage they do is your responsible. 171/2 you are making a big mistakes because he is not liable for any thing he could destroy your place and you would be totally responsible for it because he is a minor.and if he threw a party and some one got hurt you would be responsible for that to because you rented to a miner you need to rent to some one over 18 who take over your part of the lease

yes you can, and no it is not legal.

all you have to do is call your landlord, explain the situation.

as long as you still pay your part he cannot do anything about where you live. but he can stop hos friend from moveing in.

he may offer you a QUIT, which is a decision between landlord and tenent to stop a lease. he may offer to take your name off of the lease to allow him to add someone.

remember as long as your name is on that lease the property is just as good as yours for the duration. he cannot allow someone else to reside there without your permission.

Call your landlord and request to be removed from the lease. Let him know you are no longer living at the apartment and that your boyfriend wants to have someone else take your place. It then can be the landlord's decision.

If you moved back home with your mother, I'm assuming the relationship is over. If it's not, then you need to go back to your apartment.

If the relationship is over, cancel the lease or have your boyfriend sign a new lease without your name on it.

hi ya! sorry im not from Texas so, I dont know their laws. But! I will say if it were me, I would go to the landlord and tell him about the change {age of friend doesnt matter} but your name on the lease DOES! something could go wrong {hope not} but COULD! you could be held responsible!!! SO get your name off it!! hope this helps! take care!

No, this isn't legal. Your name is on the lease, you are paying your end, and he's not of age to sign a lease anyway. I would tell the boyfriend to forget it.
