Why is it legal to 'scalp' tickets on ebay?

People can get arrested or fined or whatever for scalping them on the street but on Ebay its 'ok'. Why is that? I think its bull. Like tickets arent high enough in price so those that cant get them at the cheapest price when available by the vendor because they are sold out, would end up paying more on Ebay.

In most states it is only illegal to resell tickets if you are on site or within a certain proximity of the venue.

ebay is the biggest fence on the planet. they can do whatever they like. doesn't mean it's right.
