if someone hits your car with the back end of their semi and your insurance company goes after them for a claim and they hide from your insurance company does that make them look guilty? i dont really know whats going on but i got another letter saying they are suing them and that my insurance companys lawyer will call me if they need me. would this hurt his case at all?

it wasn't really a rear ending it was a double turning lane and he just decided that my car wasn't important and he wanted to use both lanes.

Fact is, in most states (if not all), if you rear-end someone, you are "at fault". Hiding will not help, but guilt will probably already be assigned by law. Most of the time, something this simple (meaning that it's defined by statute) will work itself out.
As a sideline...if your back or neck hurts (wink, wink), there may be some money in it for you!!!!

The other driver's actions make him/her appear guilty, but guilt is only proved in a court of law. Your description of the incident leaves a lot of details unsaid and unclear at best. It is impossible to tell from your description what really occurred so any opinion given based on what you've written here would have to be in error.

If your insurance company filed a subrogation lawsuit and the defendant is evading service, then this is not admissible evidence in court.

from what it appears, it sound like they knew they were at fault and if that was not the case then the insurance would not go after the persons involved.

yeah! trust your instincts if you do feel that your'e being blindsided then tale the extra mile in suing them for your own gratification. ACCESSORY may be the legal term.
