Each state can set a minimum wage that is higher than the federal minimum wage. The current minimum wage in California is $6.25 and has been so since January 2002. Under legislation passed this week, the minimum wage will increase by 75 cents per hour in January 2007 and another 50 cents in January 2008. 75 this January, 50 next year

It'll probably happen on a statewide level long before it happens at the federal level. Currently California and a number of other states have minimum wage set to higher than the fed govt requires.
