Does that mean when someone's criminal background is run it will come back as No Record? Or as Record Attached?

I study criminal law. This is the real deal: Having a charge expunged does not mean that there will be no paper trail/or that there will be no record. This means that there will be no public record. The law enforcement etc. will ALWAYS know the criminal past of a person.

Any record regarding the case is completely removed as if it never happened. If a case is not expunged, there will be some record of it in some file. Even if found innocent there is a record of that. Expunge would erase any court proceedings, charges, investigation and the like. In effect it never happened. In reality, I don't think this ever happens. Once the government, law enforcement, or military gets info on someone they will not give it up.

When expungement is granted by a district court judge, the only records they have the jurisdiction to seal are the records of that county. There may still exist record of the charges or convictions in the police department records and the state Bureau of Criminal Apprehension [BCA] computers. Expungement is not a full erasure or deletion, it is more of a "locking up" or "sealing" of the file.

It means that they delete the record from their file. So when they do a background check, it will come back as no record. If they have your fingerprints on file the company will find that out though if they know who to ask and will see that you don't have a criminal record, but since your prints are on file they will know you have been charged with a crime of some sort.

If it's expunged then it means that it was wiped clear of your record. So it will be no record
