I have a CCW, which is a misdemeanor 1. If they find me guilty, I've been told that I will have to go back to get a "sentence". My question is during the court date that I receive my "sentence" if they decide I should be in jail, will I be arrested then? If not, how does it work?

Normally, when the judge sentences you to a jail term he or she will instruct the bailiff to take you into custody. The only thing that would change that is if your attorney says you would like to remain free on bond pending appeal of the verdict and the judge agrees. (Not normal for a weapons charge.)

If your attorney doesn't cut a deal prior to your trial where you know what your sentence will be, (fine, set aside sentence) I would have it in my head that I'm going to stay at the county facility for a while and get your affairs in order.

Usually don't order jail time for a first time offense misdemeanor, it will probably be a fine and community service or a set aside jail term. (Unless you have other charges pending, like pointing the damn thing at somebody!)

If the judge sentences you in court, they can take you into custody right then or give you some time{usually a week or so} to get you business in order before you actually go to jail. If you want to go to jail right away, just tell the judge that you wish that the fleas from a herd of buffalo infest his armpits...........

What state doesn't arrest you first for a crime and then tell you you could be inn jail for it, also what exactly is a CCW crossing the concrete white line a little more info would help you out a alot in my belief

Generally the courts give you a 'report date' and a form to bring with you to the workhouse for when you turn yourself in to custody. There is usually some small amount of flexibility in choosing that date so that you have time to get your life in order before going in to jail

Yeah, they would arrest you then, but believe me you are not going to jail over a misdemeanor!!! I know I racked up like 6 in one night, and all I got was a couple fines...

Yes! If they sentence you to jail or prison time you will go directly from the courtroom into custody.
