this man has been living in my basement for 5 months and i had no idea. when i say living, he has a furnished room..
i came home early from work last week and caught them in the act. when i told him to go home, he went downstairs. i followed him to find that the storage room had become a bedroom. i went to confront my wife and she had already left (i haven't seen her since).

in order to get him out of the house i have to evict him...according to the police.
i am so upset right now. since my wife left, i have no one to help with the bills.. should i just charge him rent so i can make ends meet? he doesn't have anywhere to go.

I'm so sorry this happened to you. Do not take rent from the man. You should call legal aid and find out exactly what your legal position is. You have to ask them for help on how to serve the eviction and get a divorce. Find out what your financial options are from a legal standpoint are, given that you are the wronged party, you have a right to your wife's assets and to support. The reason your wife has disappeared is presumably because she has thought of this, as well as what you might want to do to her. This will not be pretty, but I would be really draconian if I were you. Do not mess around. Go strictly by the book, and act as quickly as you possibly can.

Make him pay rent. Also include power, water and gas bills with it. Lock your refrigerator and everything else that he may have access to where food it store. Charge him weekly and get a contract made up with all the information. Then when he don't pay give him a 3 day eviction notice. It may be a very good ideal to take a video inventory of your house and change the locks.

I would call the water, gas and power and disconnect today. I may also drop by the pet store and buy a box of snakes and set them free in the basement. While the power is out, time for a little home remodeling -- like tearing out the meter and fuse box, water heater and some wiring. While you are at it, cancel all your credit cards, empty the banks accounts and pay a mover to pick-up and store all your belongings. Then move out and let your $lut wife have it till the divorce. Then the nastiest lawyer in town,(you know, the one you hired today), forced the sale of the home in the divorce settlement.
Or shoot both of them.

Oh come on now...are you seriously saying you had absolutely no idea someone was living in your basement this whole time? lol...don't you ever go down there once in a while? OK, if this is a serious question then why not just go to court and get a notice of eviction and get rid of his ***, unless of course you want his money (which is not a bad idea) considering he was shacking up with your wife in your own home w/o your knowledge.

Wha...? Someone is living in your basement and you don't know? Your wife has a live-in boyfriend and you don't know? You didn't know things were changing in your marriage while she is "accommodating" another man in your own house? Wow. That is about he epitome of dense. I guess at this point you deserve it. Good luck on the bills. At the least, have the guy cook and clean since your wife isn't there to do it anymore.

Dude, It's a no brainer!! Charge him rent to help your finances. Start eviction proceedings immediately. After he is evicted, rent the rooms out to someone else.

Yeah charge hime rent and ask for a large security deposit for the deposit he made in your wife! Still trying to figure out how he lived their 5 months without you knowing. Have you been gone that long?

Change the locks on the front door and toss his stuff out the door. He was there without your knowledge or concent. It's breaking and entering. Your wife isn't there to say otherwise. And if she does? Just makes it that much worse for her.

charge him rent and if ur wife showed back up and lived with him or whatever double the rent that is one wild story man good luck

Yes, that sounds like it would work out best for you and him. If your wife comes back charge her rent also.
