A 12-year-old girl feared abducted to Pakistan by her father says she is happy and does not want to return to the UK.
Should this guy be arrested and be returned to the UK - and the wee girl returned safely to her Mother..

The point is moot. The father broke UK law, and so has UK law to answer to. If the child wants to be there or not doesn't factor in. She's a minor, and as the law goes, has little choice until she's old enough. In this country we work on a flawed system where, in the majority of cases, the mother gets custody of the children. Following the letter of the law, because the father didn't request custody, he should be put through a criminal investigation and the daughter should be brought back to this country. That's the law, whether you like it or not.

From the reports, it would seem the daughter left of her own free will, and is quite happy were she is. The mother on the other hand appears to have been using her as a pawn against her ex. By denying the father access, he maybe felt he no choice but to go behind the mothers back (even though the child agreed to go with him). However, if the mother had full custody and the child had been taken against her will, then abduction charges should be laid and extradition sought (weather or not Pakistan would recognise, the mother as the legal guardian is another matter), but nothing supports her allegations so the matter should be left alone, end of story.

He should return to the UK with the girl and let the matter be settled in the courts. At the age of 12 the girls' views will be taken into consideration. While he has committed an offence his arrest would only exacerbate an already bad situation. If, as the girl says she was not allowed contact with her father for 18 months, her mother should explain why.

If it was the other way round. Kidnapped from Pakistan to England most of you would be supporting it. True or false?..Oh my answer is no. The girl is happy and arresting the father would make her really sad. The best solution is for both parents to have some sort of communication for sake of the girl and keep the law out of this. They did not involve the law when they had her.

It is far too early for any of us to make any such judgements. We, the ordinary public do not have access to the full facts of the matter and should not be swayed by sensational reporting by the press, Sky News included. Sadly, much of the reporting is typical of the racist knee jerk reaction of the British press. Before anyone writes to criticise me, I'm white, caucasian, British born and bred. However, I do belivee in the rule of law, and do believe that there may well be a case for the custody arrangements relating to this child to be reviewed, if she is being denied contact with her father purely because she is being used as a tool by her mother.

Hmm! I am not sure WHY he should be arrested if she has gone willingly and the authorities are happy with that. I understand she has told her mother that she does not want to live with her. So I guess maybe it is better than the child running away and living on the streets.

Surely the childs welfare is paramount - and this includes her happiness. But then I suppose, is she old enough to make this decision for herself?

Impossible to answer - there are so many ifs, buts and maybes?

She wasn't abducted, she went of her own free will. Nice to see you getting the facts right again. I suspect you want her father to be arrested because he has brown skin and a beard, going by some of your other questions.

Her mother might be able to get her back to the UK but if she wants to stay in Pakistan then why not?

No, he should be bared from re-entering the UK and the girl should be given more time to decide what she really wants by spending a set amount of time in both countries with one parent at a time before making an educated choice. This should be followed by a period of time, say until she becomes eighteen ( an adult) before rescinding rights to live in one country or the other.

Not long since she was on the News - she says she went freely and was not abducted.She looked happy and relaxed to be with him and said she was unhappy that her mother had refused her father access to her for 18 months - but then, who knows what the family history is?

For her sake, I hope it is worked out quickly. Pity it has to have world wide media attention.

This is a custody battle involving people that none of us know. It has caused much controversy and questions raised, but if you split from your partner and had children how would you decide who they lived with?.....Some people are given the choice. She clearly wasn't taken against her will cos she would never have made it on the plane, she would have created too much. It's a custody battle on an international stage!
