recently opened a record shop and obatain records and cd's direct from distributors on an account basis, We are thinkin of startin up on e bay as well and have been told by someone that technically to sell promo titles on e bay you need permission of the labels they have come from, is this true?

They say right on the recording "For promotion only - not for sale" but if you will look here you will see plenty for sale.

it is illegal in the USA, to selll a promotional item at any point in time!

For the most part, companies only go after the items which they are currently promoting. i even told one company of someone selling promo items on ebay (it was some re-issues that had not come out yet) and never did hear if they went after them or not. i didn't even get a 'thanks for telling us' email from the company.

ps
it's also illegal to sell bootleg cds and videos and other media as well.

Check the copyright notice if there is one, or the agreement you have with the record companies. If there's nothing about resale then you should be OK if you sell them as a private seller.

I would think so. Seems kinda like piracy to sell w/o permission. Promotional products aren't meant to be sold .
