i let my friend have my second phone that i was approved for because i was approved for two phones. She renewed my contract without my permission another two years without my permission and changed other thing without my permission with her cell phone because she knows my ss#. I told her i will turn off the cell phone and she told me she will pay the bill but give her a month so i did. BUt now she still hasn't made a payment on the cell phone bill. it was only a verbal agreement for her to pay for the cell phone. My contracted ended because it been two years and now i am with t-mobile but her contract wasn't up yet and when i found out she renewed it i told her i was going to turn it off. If i take her to small claimes court what ground do i have to stand on and how can i prove my case since it was a verbal agreement. I have a text message still on my phone to show that she will pay me but thats the thing its a text and i dont know will that work.

i did cancel the contract and the reason why she know my ss# is i gave it to her to act like she was me when we were in college because financial aid was giving me a hard time and i call continously and i told her to tear the paper up after i gave it to her but she did but she rememborized it. But if she do decide to use it to ruin my credit i will put her *** in jail. and no i am not stupid because she paid her bill but when she renewed the contract i canceled the phone. I wrote her a letter telling her that she is responsible for the bill and if she dont pay Iam going either have to pay it or take her *** to court but you live and you learn its life

Take her to court. Don't walk, run. And by all means cancel the contract.

You also have another issue. This untrustworthy person knows your social security number. BAD move on your part.

Check your credit reports and make sure that all the accounts that are on there are really yours. You get one free one a year. Go to annualcreditreport.com. Also, I'd write each of the three bureaus and tell them that the only way accounts can be opened for you is if you give written permission. The 3 bureaus are transunion, experian and equifax.

I don't thinkt he issue is whether or not you can prove she said she would pay. The fact is you KNEW this all along, for years and did nothing about it and I think thats going to make you liable for it. Besides if you friend doesn't have the money then suing her gets you nothing but a piece of paper that says you won and further in the hole because of the expense involved in filing a suit but it doesn't get you any money. If she had done this without you knowing it then she could sign an affadavit of responsibility and they would go after her for the money but you did know and were frankly, irresponsible in letting it continue so I don't think you have a legal leg to stand on. The fact is you could have called any day, any time and terminated this phone and you didn't. Suing someone because you were a sucker is not very practical. Suck it up and be smarter in the future, I'd also be more careful about who you call your friends!

Yeah you should sue evidently she is not a friend. Anyway yea a text message would be part of the evidence, also if you have any bills or statements from the company get them and keep them to show the court then you will be sure you will get your money back. Why did you give someone your ss# anyway? I guess you learned your lesson no matter if you know a person really well.

Good luck... I think this is going to be a tough one. You might end up having to pay the bill.

At least you can take this lesson from the situation: if you ever do anything money related with people regardless of who they are (family, friends, strangers) always do everything in writing. Especially if it could end up being a big sum of money that you can't afford to loose.

althought that 2nd phone was in ur name, the phone company can provide u with detailed bills that shows that she was using it. U can also provide as proof that she's paying u monthly before.... go to small claims court and state your case.

But if she took YOUR social security number to renew it...can't she or the company get into trouble? You can't use someone else's social security #, right?
