My son's father has not been in life and I want to know if anyone knows how I can terminate his paternal rights so my husband can adopt him.. i live in Georgia.. any advice? he does pay child support however.if he gets his rights terminated and my husband adopts him, can i change my son's last name? if i can, would it be my maiden last name or my married one?

You need the fathers permission. A selling point to him may be that he will no longer have to pay support. You can change your son's name to which ever you like.

I am going through the same thing right now, except that my child's father has not paid child support in well over a year and we have not had contact with him in a year as well. I know that after 4 months of no contact it is concidered child abandonment and the terms are different. I think if he is still paying his support and seeing your son, then the only way for your husband to adopt him would be for him to agree to sign away his rights. Another way would be if he is doing something illegal that you could use against him (ie. drugs, violating court order etc.) Many attorneys will talk to you over the phone about your options if you make an appointment. That's what I did. Hope this helps. Oh! And I think if you change his name if your husband adopts him, it would have to be your married name.

you can not terminate his parental rights. only he can sign those away. If he doesnt want to give up his parental rights then your husband cant adopt him. Also if he does give up his parental rights then he will no longer have to pay you child support. The only thing you can do is askhim to sign the papers. if he wont there is nothing you can do

Your son's father has to give up his rights.. you can't do it.. after his does, then you can legally rename your son

why should your new husband pay for another mans child, make him pay support and make him responsible.
