The Constitution is a guideline for how the government works and how it interacts with citizens. The First Amendment begins, "Congress shall make no law...", and goes on to say, "...abridging the freedom of speech..."

So it's NOT OK for Congress to set such a guideline, but IT IS OK for a private entity (such as a company) to have such a policy. I think if you tried to challenge it in court they would say something like, you are not forced to be on Yahoo, you have the freedom to not make use of the service if you don't like the policy and it would not infringe on your rights if you didn't use the service.

No. Yahoo is a private company that is entitled to establish it's own code of conduct. Those rules are readily available to anyone. The first amendment says that congress shall not abridge speech meaning that you can protest in front of the white house all day long.

You can have your freedom, just not where ever you want. Spout your wisdom to your hearts content on almost any street corner. While you are on yahoo, follow the rules of yahoo that you agreed to when you signed in.It isn't too much to ask of anyone.

This is technically a private organization. It is public to all who have not violated their guidelines. They can establish their own guidelines, ban you if you complain about it. If it gets to the point of social harm or damage, the gov't can restrict yahoo! but it wouldn't matter - you would be banned anyway from this public forum.

No. Yahoo is a private company and can set the rules for their site where they want, so long as they are not outside the law themselves.

If you want to be a racist, you can go to the corner of your street and spew your tripe. That is your right. It is their right to not have it on their site.

Absolutely not.

You are free to post your stupid moronic dumb-buttocks racist posts on your web site, but not Yahoo!'s web site.

That would violate Yahoo!'s right of freedom from moronic posters.

The 1st ammendment grants us freedom of speech, however, we are still accountable for the things that we say. You are free to yell FIRE in a crowded room but if someone gets hurt as a result of it and there was no fire, you are held liable.
