As I understand, over time is payed after 40 hours. BUt if you take a vacation day off and you work a total of 42 for that week with the 8 hours of vacation pay, are the 2 hours still considered over time and should they be paid as time and a half or are they paid as regular pay? Any links would help. I am in Texas and I know every state might have different laws on this. Thanks.

It is against federal law to not be compensated for overtime hours in some way.
The amount of compensation may be different from state to state.( usually 1 and 1/2 times regular rate)
I have worked for a company before that they would not pay this overtime compensation and I raised hell until they did but if it's not a substantial amount that is worth the legal BS.
Most likely all you will get is a headache and a pink slip.
Corporations that do his are very adept at screwing the little guy to get ahead and your likely best served finding better employment.

40 hours is 40 hours when you actually work them. if you work all 40 hours and then have overtime it is time and a half. but since you have taken an 8 hour vacation you have only worked 32 hours plus 8 hour vacation and then an extra 2 hours over time what this really says is you worked 34 hours and taken 6 hours of vacation. so you will not get any over time but you should have atleast two extra hours of vacation time to use in the future.

You are correct -- if you took a day off and it was "paid vacation time" then that counts when computing regular time. So if the total hours, including that time you took off, is 42 hours, you should be paid for two hours of overtime. Yes, different states have different laws, but the overtime laws are Federal, so they apply to every state

Did you actually work 42 hours or does your vacation day contribute to the 42 hours?
If you actually physically WORKED 42 hours in the work week then you should get 2 hours of overtime. BUT if you worked 34 hours and took a vacation day, you do not get any overtime.

you have to make up those 8 vacation hours, THEN you'd get overtime pay. its like working 48 hours. the vacation hours don't count as regular pay, since they are "giving" you those hours.

most don't consider vacation pay with regular pay
you will prb get 8 hrs vac and 34 hrs reg
