An ongoing construction next door, brought about a hole which was excavated for an addition and will be closed again soon- but it is close to the tree roots, there since 8 months, and about "1/4 pie" of the tree roots.
I can reach the tunnel entries of the carpenter ants, is there anything I could pore in there?
The tree and the ants are about 8 feet from the house.

You should remove the tree. Once the ants get in there it's pretty much a lost cause, and you don't know the extent of the damage they have already caused. Also if the crown fading the tree obviously isn't doing well. At least remove the top of the tree and thin the entire tree out a bit. Try to determine the extent of the ant damage. You don't want it to fall on your house, or onto the new construction(then you might have to pay for damages).

Malathion should take care of the ant problem...

If the tree is dying you will need to take it down. I certainly would look at having the contractor assume liability for damaging the tree.

You may have a bigger problem than the tree. Have your home inspected for the critters. They can destroy your home.

Be certain they are not Fire Ants. They never sting one at a time. They sting as "group" at the same instant. They kill young animals by entering every orifice of the body.
Humans can die from their stings. My late wife almost did.

You need to kill the Ant Queen- and if you remove that tree, you home or the other guy will become there food supply, kill out those ants. then remove the tree. probably dead anyway.
