Yesterday I was in a bad automobile accident. The other driver was at fault (failure to yeild during a left turn.) I was wondering what sort of legal recourse I have in this matter. I did go to the hospital, and I have a chest wall contusion, and I plan to return to the doctor because I can barely turn my neck, lift my daugher, etc. Has anyone been involved in a battle with an insurance company? What is the best way to ensure you get adequate compensation? My car was an '85 Pontiac, and ran perfect and looked good. The blue book value is only $709, but we have put at least triple that in the car just this year (new exhaust system, alternator, vinyl top) and it is our only car. How do I make sure I don't get screwed, and get compensated for my injuries (not just the medical bills.) Serious answers only.

NO: people who drive like they have no sense, would rather chat on their cell phone, and crash into unsuspecting people on their way to work are the reasons insurance is so high, and give these lawyers their job.

Yes, the other driver was cited for failure to yeild on a left turn.
No, I can go and pick up the police report from the department tomorrow.

I PRESUME you were insured.
Was the other driver cited by the police?
Do you have a police report yet?
When you gather all of your information, go to YOUR insurance adjuster. He/she is paid to be YOUR advocate and to see that you are compensated for your injuries and inconvenience.
TIP---->At this time, while your memories are fresh, sit down with a cup of coffee or a Coke or (?), without ANY distractions and write a narrative of events leading up to the collision and after until the police arrived. This will serve you well in case it take several months to settle. This will give you something to refer to for refreshing your memory of the event.
As far as your car goes, you will be compensated for it, and maybe even generously, but don't hold your breath for anything over about $1500.00. As for the repairs you have done to it,that isn't even considered. It is the worth of the car, not its worth to you. There is no place in law for sentiment (sorry).
If you don't THINK (not feel, but think) your insurance adjuster is working well enough on your behalf, THEN find a reputable attorney for representation, BUT be warned, HE is going to collect the better part of your settlement.

one call thats all!! im sure you know what im talking about. those ambulance chasers say that on tv. call them. if you are not at fault which you said you werent, you'll have no problem winning. what they dont tell you on the commercials is, they winn like 425k but they end up taking home about 90-100 k of it. which isnt bad by any means. but the rest goes to the attorney. best of luck to ya. that sucks your car got totaled

What?? This happened yesterday and you are already talking legal recourse and battling the insurance company! You are exactly why lawyers are rich and insurance is so high.

Call one of those "ambulance chaser" lawyers, get a phone book and look under attorneys. Theres about 80 pages worth. good luck and I hope you feel better

Talk to your ins. company about the whole problem(be specific), they talk to the other company and get things straightened out.
If the comp. is not enough then worry about courts
