legally you have recourse as they stopped payment. sue them take them to court get a lawyer if the money is over 5,000 dollars. under that its small claims court but you can still take them to court as long as you have documentation of the transaction and the cancellation. i would also call your sheriff to see if criminal charges can be put into place as they just stole your horse through fraud

Hetty is right this is theft by deception, and if they took the horse or ether property they can be charged with flight to avoid prosecution across state lines and is a fed. charge, also transport of stole property across state lines and many other laws.
I only hope that the check was not stolen, and that the address and names on the check were of the people who bought the horse.
This is a comon con, and the horse has probably already been sold, but if so then they are also guilty of selling stolen property and you may be able to recover the horse.

If you sold horse over $500, that can be charged with Grand theft of stolen property and fraud.
What you need to do is contact your bank and contact officals. They can trace based off the check and account. Plus, contact officals in that state the horse is in as well.
Never EVER release a horse until the payment is done for reasons like this. If these people are the % that do their buying/selling based off fraud, that check could of very well been fraud. I never sale anything until I am paid in full.

Sorry hon, one of the oldest scams. Is the horse registered? Do you have a old coggins with identifying marks or picture on it? if so you call the police and report the horse stolen and notify the state the horse is in. depending on the price/value of the horse it could be a felony. you will probally find they have done it before. also notify all equine vets in that area. (if you can) post their names on EVERY horse site you can w/a pic of the horse. good luck.

start legal procedings and call the state attorneys office to report that the horse was stolen. you should always never let anything go until the payment clears especially if they pay with a check. you can charge them with theft. good luck

It doesn't matter if they are out of state.... they are considered to be horse rustlers. They face big time jail time or prison. take your to your DA... do you know where they went with your horse?
They have stolen your property.....If you are in Texas... go to the Texas Rangers... they go into other states to arrest people that have broken the law in Texas. They don't like horse thieves.. it was a hanging offense in the past.

Big mistake on your part. Always take cash or a cashiers check and go to the bank with the people and cash it. I suggest you contact the authorities and get them involved as soon as possible before they sell the horse.

File a police report. Does their check have their address on it? You could try to check it out and see if you can "steal" the horse back.
