Hi,

A while back I got a speeding ticket in Staten Island, to which I pleaded not guilty and have a hearing in september. Recently I found out that at the time that I got the ticket, my licence was suspended. The officer somehow missed that and ticketed me only for speeding. Is this admissable in court to dismiss my ticket or does this information only get me into more trouble?

To elaborate my question, If a speeding ticket is issued to a suspended licence, is it a valid ticket? and if they realize that I was driving with a suspended licence a few months back, will I be in trouble now?

I did not know my licence was suspended, had changed my address and all correspondance was going to my old address which I thought usps would forward, but...!

any help will be GREATLY appreciated!

Plead guilty to the speeding charge and stop wasting taxpayer money.

i would imagine that the prosecutor will run your drivers license check before your hearing and likely see the suspension and already know about it when you go to your trial. the officer who issued the ticket will likely be at your court date to testify about the stop, since the prosecution only has the issuing officer as their only witness to testify against you. DAS or driving after suspension is another charge they can file against you, not a benefit to you.
the "old address" line is never accepted since it is each driver's responsibility to keep the department of motor vehicles updated with the current address, they never accept that as a reason in my experience.

I don't know about NY laws, but sounds like your license was never suspended and the speeding ticket remains valid.

Double jeopardy means that you can't be charged with driving under a suspended license.

I'm sure your lawyer explained this in great detail?

The validity of a speeding ticket has nothing to do with the status of your license.

Oh yeah tell them you were driving with a suspended license and they will give you a prize for being so honest........NOT.

My dad was a lawyer. My brother is a lawyer. Do not volunteer any information. Answer their questions as briefly as possible. Deny Deny Deny.

If they don't know, don't tell them. All you'll end up with is another fine for driving on a suspended and losing your license for an even longer period time.

I agree with what Wendy stated....Let them dig for the info. DO NOT divulge info to them. You were caught speeding; end of story. If they do not know about the suspended license, do not tell them.
