Can I be violating the Terms of use?

Question

I find an image/brush/patter whatever online that is not for commercial use, so, I don't use it in that way. Whatsoever, I have a client that want a website (personal) with the image/brush/pattern in question.
While I am not selling it, I am being paid for the job using it. What should I do in a case like that?

if you cant decide, dont use it.
