I'm thinking this problem most likely has little or nothing to do with fluid (unless you've let it virtually run dry that is), although you should check yours regularly and make sure it is filled and the fluid's clean. If you haven't had the transmission serviced anytime recently (new fluid and filter), then this might be a good time to do so.
Most modern vehicles have an interlock mechanism that requires you to step on the brake pedal to get the car out of Park. It is possible that you either aren't pressing down hard enough on the brake pedal, or that this interlock system needs adjusted somehow. That, in my humble opinion, is the likely cause of your difficulty. I'd take the car in to a dealer or mechanic, explain the problem, and let them check things out to be sure. It might just be a matter of adjusting the linkage.
Hope this info helped.

Well, this all depends on weather or not you're parking on an incline. (hill) That is pretty much normal.
One option is to set your parking brake prior to putting the car into "park" AND putting into drive before releasing the park brake.
If that's not the issue, then you probably have problems with a worn park lock inside the trans.

usually when that happens, you are running low on trans fluid. go under the hood and look for a dipstick for trans and check the level. add whatever your low on. if its still there, It may be a problem in the lever itself or worse the trans itself

probably need to clean out your transmission or get a new one depending on what type of car it is, the year, what its been used for, and the mileage.
