G'day Andrew D,
Thank you for your question.
The foul pole is a misnomer since it is in fair territory. However, it marks the boundary between fair territory and foul territory. They help umpires to determine the boundaries between fair territory and foul territory. However the batter is given the benefit of the doubt when he hits the foul pole of having hit a legitimate home run.
Author Vince Staten has written about this in his Why Is The Foul Pole Fair? (Or, Answers to the Baseball Questions Your Dad Hoped You Wouldn't Ask) . It is well worth a read.
I have attached a source for your reference.
Regards

I think the person was asking why it is called the foul pole if it is in fair territory. That's just the way it was named in the old school and it stuck. It's not completely accurate as the other answerers pointed out. It should be called the fair pole.

The pole is fair/foul indicator in the air, as the chalk outline is to the ground.
If a ball hits the chalk, it's considered fair. Likewise, if the ball hit's the foul pole, it is a homerun, because it still in fair territory.

It's not that the point of reference for the foul line. However, if a homerun hits the pole its a homerun not a foul ball.

because it would be easier to see the ball hit the pole to determine it is fair... Just like a ball hit down the line.. If it hits the line it's fair...... And if it hits the pole it is a homerun.... depending on the ground rules

if a ball hits it then it is fair
if it goes on the outside then it is foul.
