My ex hasn't seen the kids in over 2 years. He is self-employed and doesn't pay a dime. He is scheduled to pay under $300 for both kids. If I reopen my case with the DA and modify the amount how can I get more? I have a husband who pays for everything and I am a stay at home mom, but the "birth father" should be the one to support his kids.

They can only legally make him pay a certain percentage of his paycheck (40-60% max depending on state and many other factors).

You would have to file a motion or an order to show cause for modification of support based upon changed circumstances. You could then get an order to garnish his wages.

Also, report him to the District Attorney's office and they'll have him arrested. Not paying child support is as evil as murder in the eyes of our government.

have them pull his tax records to prove how much he makes i pay 5 times more than him for 2 kids but i see mine and would take it to court if i couldn`t

Most doctors with there own practices pay about that...

So good luck, if he looses money in a business they basically considered him unemployed
