It depends ont the state you live in and the nature of the lawsuit. What was the suit for? Was there a contract or statute authorizing attorney fee recovery?

I believe that this is only possible if the case had gone to court, and the petitioner got a judgement against him.

The respondent's claim is that the suit was frivolous, and for an ulterior purpose (not a good faith claim). If proven, the respondent can recover their costs in defending against the 'frivolous' claim.

It's a legal tactic.
