ok can they just search me for no particular reason but then i ran and they tried to shoot me! im wonderin if they can really do this

but the cops NEVER caught me this is like the 10 or 12th time ive ran from them either becuz i had a fight, had weed on me or runnin from them jus for fun because i crack the glass on their car with a rock lmfao.

okay... u had an illegal drug on you... and you were noncompliant when they were trying to search you....

the thing is.. if you had nothing to hide... you wouldn't have run away... that's how they see it...

and they're right.

Technically, they do not have the right to search you. However, the usual tool they can leverage against you is refusal to be searched = probable cause. With probable cause, they have the right to make you sit there and wait until they get cleared for a search warrant. Thus, at the end, they have an indirect right to search you. As far as use of deadly force, I think that was a little overboard, but if he was willing to open fire, he probably knew the consequences. If what you said happened to you was true (and even if not), this should be a wake up call to get your sh*t together and stop playin' hood rat before you wind up perforated or in jail.

If you were acting suspiciously or smelled like Marijuana that would give them a reason to search you (the legal term is "probable cause"). If they didn't have probable cause, then you would have been well within your constitutional rights to refuse their request to search you, and if they did search you and ended up arresting you, you would have a case to have their charges dismissed for illegally searching you. Still, that's a huge legal headache.

As for running away, you should never run away from the police, because the fact that you fleed from them now presents them with probable cause that you have committed a crime. They were not, however, allowed to shoot at you (and I doubt they did... stoner).

1. They can search you when there is a reasonable belief that you have committed a crime, for example, possessing illegal material. Reasonable means that a reasonable person would conclude that it might be so. This does not require solid proof.

2. Running from the police during an arrest is a crime. If the police concluded you were dangerous they might shoot. But I think you should retain a lawyer to analyze your case in detail.

In order to search a suspect, law enforcement must have probable cause. Such as, smelling the marijuana, noting you looked or acted high, etc. If you flee most law enforcement agencies keep strict policies regarding detainment and use of firearms. If they were using live ammo (not a stunning mechanism or such) they would likely be repremanded by their superiors. All depends on where you live though.

If you run from the police... That's a crime, or suspicious activity at the very least, and legal reason for search. You're lucky you weren't badly injured / brought down hard. Don't run from the police and complain about anything that happens if they catch you.

Having guns drawn on a fleeing suspect is a precaution often taken. If shots were fired at you while you weren't holding a weapon... you have a case... good luck proving it...

Ok well the police have to have probable cause in order to search you, if they did then it was right for them to search you but if they didn't then they violated your constitutional rights. Has for the fact of them shooting at you, I have no idea why they would do that, either they know something you did and you were considered dangerous to them or they maybe just had the wrong person. I mean did they tell you why they were searching you? It just sounds weird they they started to search you for no reason, that is just wrong.

Where do you live???? They tried to shoot you??? The police can pat you down for weapons for their safety. If you were under arrest, they can search you. Marijuana is illegal and running from the cops is evading.... So, you were WRONG!!! Police do not shoot at people for no reason. What were you doing that made them try to search you?

They obviously had reason to search you and because you ran, they can use any means necissary to catch you. They weren't trying to kill you, just slow you down. I'd quit messing with that stuff and get right with the Lord. The police can do whatever they want!

yes they can search you- especially if u r not carring an ID . They arent supposed to shoot unless u r using violence to resist or other wise threaten, like they think ur reaching for a gun..etc. Be glad ur okay. stay outta trouble! They might not miss next time!

If they felt they had reasonable suspicion of your having committed a crime, they can search you. Obviously, since you had committed a crime, they might have had said suspicions. While you did resist arrest, I'm not sure if the trying to shoot you part is legit, if you were unarmed.
