he is in forclosure on his home and owns a new 06 truck that he recently had air brushed, he lives with his rich GF and he wrote a letter to child support that he is unemployed and unable to pay at this time. How do I survive? Rent is behind I cant afford school supplies or clothes, I do go to food pantry once a month but this is rediculous.

I am employed and have added hours to my scheduled but it now school is starting and I can not work past a certain time as I need to be home with the kids, I can work Saturdays too... but still I am behind on bills due to him not paying on time. I want action on this and child support just keeps sending arrearages letters and warning letters, its like they have so many other dead beat dads and its hard for them to keep up.... What a bunch of crap

Here is another detail I left out, I do get Public assistance,,, for child care mostly during the summer months and health care. I am not eligible for food stamps as my income is just above their requirments, but food pantries do help.

My advice you keep doing what you doing, What ever he is doing it will not go unoticed, You can get a lien on house, but you will need a lawyer and also, as soon as he starts back to work they will deduct back child support until he is caught up. But you got to keep calling and letting them know that you are not receiving your child support. I know it is hard, but I got through it and he lost everything, anything that he had with social security number on it you need to get it because that's how they keep up with his employment. Find out if and when he filed for his taxes and you can also find out if the GF and him are living together, and they will take her income until he is working again.
Hey if you go for welfare and approved which you will be, everything that state has paid into you when they find him he will have to pay that back as well. If I was you I would let him know I am going to apply for welfare and it want look pretty when they find out that you have not paid your child support. Go ahead and put the lien on his truck and the house they are trying to foreclose so you can get your money

My wife has a deadbeat ex. Every time he gets an income withholding order on him, he quits his job. So in effect, he hasn't paid in about a year. What we had to do is report him to the prosecutor's office since they are ones who do child support cases here in Indiana. They ordered him to appear in court for Contempt of a court order since child support is required by law. At that point, the judge should give him 2 choices....get a job and start paying or go to jail. My wife's ex didn't show up for his contempt hearing so now there's a bench warrant out for him. NOTIHNG in this moves fast. And if he goes to jail, you still don't get child support. It just gets added in to the arrears. But then most people would pick to get a job over going to jail.

Take him to court, really child support enforcement should be doing it. They can order him to seek work, take his drivers license, fine him for even more money, incarcerate him. Make sure if there is anything left after the foreclosure that you get it to go against the child support arrears. There is also a database that they can search to see if he has any money in bank acounts, etc.

he can't just write a letter and say that he doesn't have a job and can't pay child support. Report that he's behind on his payments and they will either force him to pay, schedule a hearing, or send him to jail. I don't know if you have a job yourself, but I'd try to find something that can fit into your schedule... even if it's selling Avon... for extra income.

just take him back to court and let the judge know that he is not paying like he should.
Then try letting him know you will cut back on visitations if he has them.
Also if you can take a photo to court of his truck that will help as well.
