My spouse filed for divorce in New York in October 2004, we've gotten nowhere. He and his lawyer have played dirty every step of the way. I moved to Texas in February of 2005 and I want to file for divorce here. Is this legal?

Ask a lawyer about jurisdiction but from the dates you gave, I'm guessing you can. However, if you have actually been served separation papers or a petition of dissolution, you cannot. That's action pending against you for the same subject matter in the eyes of the law. Look for a lawyer with experience in interstate matters.

Find a good attorney.
You cannot open a new file if there is already a divorce file in process. Instead, gather up all your information for the lawyer and make sure that you get your lawyer to inform the judge of what your ex is doing (playing dirty).

ask a lawyer not sure don't see why you would need to file if one is in the process it may just make things more complex.

No, once it is filed, it is filed. It will be in the court database.

no if you have a preceeding elsewhere you cannot file elswhere.
