Let your accountant tell you. They will figure it both ways if you ask. I have also just been married a year and we got a good bit more money filing separate. So just ask your accountant.

Your marital status at midnight on the 31st of December determines how you file. If married you can file as "married, filing joint" or "married, filing seperate". The second is usually used if one or the other has an unresolved issue or debt with the irs; this erects a wall between them so the other spouse's refund cannot be taken to satisfy said debt. One downside is that you lose and retirement credits or education credits. It is also possible to file an 8379, Injured Spouse Allocation, with a return and go MFJ so you get the various credits. This answer can go on forever as there is an overabundance of information. I have done tax returns for 36 years so you can imagine what exists that I haven't seen. does he owe child support ? if so don't file with him because if they take his money, it's your money also. it truly depends on who make the most, the kids and other issues. i don't file with mine because of financial reasons.
