The second marriage is not valid, and never was.
Exception: if the first marriage occurred in state-A, and the second in state-B, and state-B does not not legally recognize the state-A marriage, then it is not bigamy in state-B.
Prior to DOMA, this was not a problem because the Full Faith and Credit clause of the Constitution did not allow for the absurd result of one state refusing to recognize a marriage from another state. Now, all bets are off.

In this case, the person who took a second spouse while being married to the first spouse would be charge with bigamy. In any case, the first marriage would stand up in court and the second marriage would be null and void in the eyes of the court.

Bigamy has been committed which is unlawful in the United States. But then there are two divorces so both marriages are ended and the crime of bigamy is no longer taking place.

When legally married (this includes separation and the start of divorce proceedings) it is a criminal offense to 'remarry' and the second and any subsequent marriages are 'void'. If he divorces both partners - the legal one and the illegal one, he is free to marry................

The 2nd marriage was null and void at its inception, and the person who "married" a 2nd person while still married to the 1st person committed a felony offense, "bigamy".

marrying more than one woman is bigamy...(or poligamy in some states where it is popular to marry more than 2)
It is illegal...most places anyway...
