If I take a picture of a Ferrair, can I sell it without breaking copyright laws

If their logo is visible on the bonnet do I break trademark laws? If so, by removing the trademark logo can I legally sell the photo

It'll depend on the context of your sales as well as how Ferrari feels about that -- to be on the safe side, consult an intellectual property attorney. The cost for a quick consult is worth it to avoid hassles later on down the road.

From a legal standpoint, it depends on the picture and how much of an emphasis is placed on the Ferrari brand and whether or not it appears if you are using Ferrari to promote your goods and services. If so, it could be a matter of trademark infringement. Otherwise, if you are the author of the picture, than it is your copyright.

From a practical standpoint, if Ferrari is aggressive, they may send you a letter telling you to cease and desist.

because ferrari dont specialise in photos of ferraris then your good to go - if you created a car in the same design as a ferrari or made a car with the logo on then that would be bad - but your not making a car

Sure, you took the picture, so the picture belongs to you, so there is nothing wrong with selling something you own, which just happens to be the picture that you took of a ferrari.
