You let someone in your home - that went to the legal system and got a restraining order to keep YOU away???

Does it matter what the time frame on the restraining order is?

So, if it is a current order, when the police show up, who do you think that they will insist should leave? Do you think that they will listen rationally to the question you just ask us? Or do they already believe the judge knew what he was doin' with the piece of paper she has?
And not care who has a deed to the house? Or the lease?
Do you believe the police know the difference between a current or an expired restraing order?
Now, really?
Do you want someone that gets a restrain order to keep you away from them?
So, are you goin to the same place where SHE got the restraining order to seek a solution?

I believe a lawyer is needed in your case. I would suspect that if she filed a restraining order against you then moved out that was probably one of the conditions of the order. If she has since moved back in then she is causing you to violate her restraining order, you could be arrested, ergo, be punished before you have a chance to tell your side to a judge. Get to a lawyer. I know, I know, I don't like them either.

NO she can not Restraining orders are enforced and who ever breaks it will go to jail.Call the cops and tel lthe mthe issue and they will gladly come to your ohuse and escort her off the property.
the Judge will be VERY upset with her if she ONLY enforces the restraining order against you when things go your way not hers. She can not have to court enforce a order like that ONLY when she wants it to be enforced.
It ias either enforced or she should not have had it done in the first place. Call the police and they will get a copy fro mthe records and read it if she is the ONE breaking it then SHE GOES TO JAIL !

Yes. If you let her move in and out, then she can. It's her restraining order, if she wants to break it she can.

You should be able to get concrete, free, advice from the police on this matter. next to a lawyer(who charges money) they are the best people to speak too

not leagelly, because you need to stay away from her for a year, she might be doing that to get you in trouble, or if she wants you she will have to take the restaining order off you.
