I agree that you should immediately contact a lawyer who specializes in family law. You should not release your child to someone who you know uses serious drugs. Also, he is not paying child support, which is another serious issue.
However, you must make these things known to the court, or else you will be accused of depriving the child's father of spending time with his child. Courts are increasingly giving fathers access to their children, which is generally a good thing. (A kid should never be used as a weapon in a custody battle.) But your child's father should not be given the responsibility for the care of a young child. Since he's wasting his child support money on serious illegal drugs, he doesn't deserve to spend time with your daughter.

Well...if you have total hard core evidence he is doing drugs of any kind, talk with your attorney or District attorney about the situation then request random drug tests on him with out him knowing. He will recieve orders from the court asking about drugtests and will either clean up or get caught!
About the going to jail part....no you will not go to jail but you will be in violation of the court orders for visitation. He can complain about that when he has the drug test done. It will only affect you if you didnt have a reason why you didnt want your baby with him. Good luck and god bless!

I am no expert but the courts have ruled he gets visiting rights, so unfortunately that is the law now and you must obey it. Simply saying he is taking drugs will not hold much water. You would have to prove it for a fact. If you can't prove it he may apply for extended visits or try to show you are spitefull and turning the child against him. In the end you may look like the bad person. I would think your best approach is to apply to take away his visting rights because of the back payments in child support.

You need to contact someone right away to let them know what is going on and that you want to change the court ordered visitation. I don't see that you could get in much trouble if you don't let him see her until things are worked out. In reality, putting your baby in the care of someone who is using drugs is actually endangering the welfare of your child, which you or you and he both, could get in trouble for. Or if he does get to have her this weekend, maybe you could go along to make sure things go okay. To kind of let him spend time with her, but be able to keep an eye on him.

you should not go to jail for denying him visitation because he is doing drugs but you will have to provide the courts that he is doing so; you can take him back to court and ask the judge to deny visitation until he gets his act together; you can also take him back to court for the child support and have it garnished from his wages; seek the advice of an attorney and possibly contacts appropriate authorities about his drug use.....protect your baby no matter what!

you can go back to court and tell the judge that you don't feel your child is safe around him,, and he can set up supervised visitation. i don't think you can go to jail for not letting him see her, but you will go for endangerment if you allow her to go there knowing that there are drugs in the house. i would really call a lawyer and see what kind of legal advise they can give you, until then don't let him be with her alone, stay if you have to. that is a serious offense. be careful and good luck

Talk to someone with the court and ask them. You might be able to have him submit to a drug test and take away his vistitation until he's no longer using, but I'm not sure. Either way, you need to have it on record somewhere that he is using before you go trying to deny him parental rights. Otherwise it might cause you trouble too.

someone on drugs is not really a good thing for a baby
let the court know about the drugs and maybe the father can only have with someone else around who the court approves off

Call the courts NOW. Inform them that he admitted to you about his drug use. If the visitation is court ordered, you can go to jail for contempt of court. Get on it TODAY!

I would never allow my child especially a little thing like that go anywhere near a drug user!!! I would contact your attorney explain the situation and I do not think that you can got to jail for trying to protect your child!!!!
