There is a sentence in an agreement but english is not my native language and i couldnt decode it. what does: ''The unsuitability or defective condition of the container arising without any want of due diligence on the part of the carrier to make the container reasonably fit for the purpose for which it is required'' ????

sorrryy.. there is a beginning of the sentence which i've forgotten to write: ''the merchant shall indemnify the Carrier against any loss, if such loss has been caused by the unsuitability or defective condition of the Container arising without any want due diligence on the part of the Carrier to make the Container reasonably fit for the purpose for which it is required'' pls explain!!

The shipper will not hold the shipping co responsable for any dammage to goods if the dammage was caused by (a defective container)

the container is not suited to or is defective, in regards to what it is supposed to be carrying

"arising without any want of due diligence on the part of the carrier to make the container reasonably fit for the purpose for which it is required'' :
The Carrier was not at fault or negligent in regards to the containers condition or construction




i.e.; The sucka that packed it's at fault,, not us,, probably true too.

If there is loss (damage), the merchant will pay, not the carrier (shipper).

ONLY IF the loss was because the packaging (container) was bad

" arising without any want due diligence on the part of the Carrier" PROVIDED the problem wasn't the carrier's fault

"to make the Container reasonably fit for the purpose for which it is required''
Because the carrier didn't use use the correct type of container.

So: "If there is loss (damage), the merchant will pay, not the carrier, but only if the loss was because the packaging (container) was bad; the merchant will not pay if the problem was the carrier's fault, because the carrier didn't use use the correct type of container."

This is in a transport contract, right?

The "merchant" is the person giving the goods to the transport company to ship from one place to the other.

The "carrier" is the transport company.

The sentence says:
- If the container breaks in transit
- because the container wasn't suitable to carry what it was supposed to carry
- and causes damage or loss to the carrier
- the merchant will pay for the damage the carrier suffers
- unless it was the carrier's fault that the container broke.

OK,
This sounds like an insurance comment about shipping.
It probably means you can't sue the company who are responsible for the container if they can show that they have made a reasonable effort to to make sure the container is ok

In other words: We are not liable for damages to the container or its contents due to the fact you use the container for some purpose other than for what it is designed for.

Believe it or not, that's not a complete sentence- something's missing. It's so far trying to say that:

if it breaks, even though you took care of it....

It sounds like part of a warranty. Is there more to it?

Sure, it was written by a moron who thinks he knows English. It means that the person shipping the cargo used a crappy box and doesn't care.

the container was broken , but it wasn't their fault, and they tried to fix it but it didn't quite work.
