forfiling the income tax return. because income tax authorities will not accept return without form 16

Move to the United States. We have no form 16 lol

Form 16 is issued ideally at the end of each financial year and it is mandatory for organisations to release Form 16 latest by one month after the closure of the financial year. The employer is legally liable for not issuing the Form 16 and you have every right to bring it to the notice of the authorities.

Firs send a legal notice to your employer along with a copy to the commissioner of income tax demanding for the release of the Form 16. If the Commissioner of IT in your location is copied on the notice, the IT department cannot penalize you for delays in filing or interests and penalties. Good luck

if he receive salary by cheque in that case he can file his return by taking detail from bank account but he has to submit form 16 with return if employer is giving form 16 he can send a registered letter by legal advisor and submitt copy of that letter with return or give an affidevit that he has not received form 16 as he received form 16 he will submit form 16
