can ebay take you to court if you fail to pay for an item that you bid on and won?

No. You can only get a bidders non payers strike. Once you get so many bidders non paying strikes, ebay will delete your account. If anybody was able to take you to court, it would more so be the person you bought the item from since when u make a bid, it is a contract between you and the buyer, not ebay.

Previous answer is correct. If you take delivery of an item but do not pay for it, not only can they take you to court, they can take you to jail -- that's wire fraud.
