sure, way i see it free speach goes both ways; him burning the flag says (i hate america) you slaping him to the ground picking him up and slapping him down again, once for every star that burns. says: i love america.

You have the right to beat whomever you like. You also have the right to trial by jury. Take a breath, let it out slowly, and remember that cooler heads prevail. A flag burning may be a good time to exercise your right to free expression: give the scumbag the finger.

Would I have the right to twist you up like the chubby old pretzel you are if you tried .... ? Don't get all tough on us now fella, we ain't all yella, and we ain't all pansies... I'm a peace loving person but it is my constitutional right to burn glory in your front yard (depending on the state) if I want to and if you were to put a hand on the wrong place, well then I'd have to take that as an act of aggression and defend myself wouldn't I ? Afraid it doesn't work that way; you're the one who'd end up in jail, and he'd be a hero to his yellow bellied cohorts. A little cussing under the breath is allowed, however. I grit my teeth and do it all the time. Freedom of speech, you know. A wonderful world.

REALLY NOW, how many times have you seen a protester burning the american flag? If you did attack a person doing it, be prepared for a big lawsuit, not to mention being arrested on an assault charge.

As much as I find the act offensive, you never have the right to inflict physical harm upon a boob only exercising his "free speech" rights.

Now if he happened to swing that burning flag at you, obviously in an attempt to kill you through incineration, then you might have a valid self-defense argument.

Absolutely not, unless it was your flag or they were trying to burn it while you were wrapped in it. Then it's self-defense. But apart from the self-defense scenario, no, you'd be wrong to attack a flag-burner. They're exercising their right to free speech. We only need free speech laws to protect unpopular speech. If we only wanted to protect popular speech, well, that doesn't need much protecting. Things like flag-burning are what define us as a country. Try burning a picture of Adolf Hitler in German 1938, or Stalin in USSR 1938. You'd be shot. But we protect that person from any harm. That's why we're the good guys.
