we are seperated, she's living on public assistance, she allows her unemployed boyfriend to stay with her when she feels like it. she verbally abuses the kids, she's 22 and yet to get her G.E.D. She doesnt value education, or understand life. very immature.

If she is living on public assistance and has someone living with her that is not employed, I would say yes and also with the fact that she verbally abuses the kids, that right there is a case winner. The other stuff just backs it up. If you can get her parents to testify in the case they want you to have custody, I would do that. My ex went through this situation before and won. Same story, different people.

dude, i am not a lawyer either. but I have been through 3 divorces, and in all of them, i got custody... here is a few tips, ok?? this is from a person who knows, ok?? you already have a plus: her parents!!!! this will work to your advantage greatly! Document EVERYTHING... all what you have told us, PLUS the s**t she has said to the kids, the verbal abuse, and an insider tip: if you SUSPECT ANY sexual abuse... report her and the b/f. IMMEDIATLY!!!! If you want the kids, fight for them.... I have seen WAAAAAY too many good parents lose the kids simply because they were men/ fathers. It isn't fair, I tell you, but i hope what I have told u helps. also, enlist all teachers, caregivers, ect who may have had any contact weith the kids. No one wants the wrong parent to end up with the kids simply because she is the mother. I hate to say it, but I have seen men be just as good as parents as women. ( that last statement, you didn't hear it from me, ok???)

You should go immediatly for a court case to get full custody of your children.
This is what the judge will see on her;
1) Unemployed
2) Claim- Verbal Abusive
3) Highest Level Of Education Completed (im guessing no high school diploma if she needs her GED)
AND, with her parents imput of wanting you to get custody, this will bring the chances of you getting custody up.

Yes, that her parents want you to have custody speaks volumes for their opinion of their daughter's abilities as a parent. The court will focus on what is best for the children. If you can provide the better, more stable environment, you have a strong case for custody.

I would press for custody in the divorce. She doesn't sound like the type of mom I would want my kids to have. You have her parents on your side because they are nice enough to understand that the kids deserve better than her. Should you get custody please remember that her parents would love to have visitation with the kids. If you can stand being around her parents, it would be one of the best things you could do for your kids. They need to know their grandparents.

I'm not a lawyer either. My brother went through a rotten divorce. Unfortunately, his ex has full custody. But I would say that you do have enough to warrant going for custody of your kids.

I bet you are glad you got rid of her-huh? It is too bad for the kids. I am sure you could win them in court. She will try to keep them because without the kids she can't get a check.

In most cases you have to prove adultery.I mean really prove it.For the kids call child protective services and see what they think on the abuse and the b/f staying there.

You need to fight for the children!!!! She sounds lazy and immature. She has no business with the children. If you can get her parents to sign a paper that states their feelings,it wouldn't hurt your case!!!! Good luck!!!!

I would say so if her own parents want their son-in-law to get custody of your kids.
