Hello-

I had a client who owed me $1200 shaft me out of $450, they sent a check for $750, which I deposited today (4:30 PM PDT). I'm a web designer and it was bad timing on their part not to wait until they had the files to do this, I'm taking their site down and taking them to court to get my money. My question is how long do I have before they can issue a stop payment and keep me from keeping the $750. The money should post to my account tomorrow, but I want to make sure they won't be able to issue a stop and have it reversed out, right before I tell them to shove it. FYI I bank at Wells Fargo they bank through a credit union that filters throuh bank one.

banks are pretty well the same throughout the world. once you have cashed thecheck, they can't stop payment on it. the only way the money will be taken back is if they don't have enough funds to cover it.

although you may recieve credit for your deposit in two days, this does not mean that the check has cleared. a check can come back several weeks later NSF (non sufficent funds) or if a stop payment has been made the deposit to your account can be reversed anytime prior to the check clearing the other persons account.
whenever cashing a check and the availablity of funds is questionable, it is best to go directly to that bank/credit union from which the check was drawn so the availability of funds can be determined on the spot.

They can issue a stop payment at anytime until the check clears their bank. Just because funds are available in your account does not mean that it cannot be charged back to you. It usually takes 2-3 days for checks to clear THEIR bank. To be safe, I would wait until Monday or Tuesday before you take any action.
