I'm not 100% positive, but I work some place where legal things especially where hiring and firings are concerned are well documented. I checked references for a candidate and was give a few questions to ask: Did he work there, for how long and what were his duties.

I was told that you can only answer-yes they worked here from whenever to whenever--but you cannot say anything bad about them-even if they stole from you--only showed up one day--was rude to the customers--beat up your other employees--etc. I'm not sure about the USA but in Canada I believe you are not allowed to say anything negative about your past employees when someone calls for a record check. To me this law is ridicules--wouldn't potential employers want to know the truth about this person-like were they trustworthy, prompt, polite, etc.

By law if you were fired by a company for stealing They will not tell the inquiring company about your history. They may tell them about your attendance, and your work habits.
I have no clue!
I do know that we held applications for about 90 days. But that was worthless. If we happened to have a position available when you walk in to apply for the job, and if you have the qualifacations you could be hired that day. We would not go through the files unless we had somone in mind that we wanted before you showed up. Most is word of mouth, and I will scratch your back, if you will scratch mine. .

In Canada, it's not legal to give a bad reference about an employee. However, you can refuse to give a reference, which basically tells a person that they wouldn't want to hire you anyway, so I'm not sure it's much better.

For liability reasons, most places will only verify dates of employment. The legalities will vary from state to state.
