My friend has not seen his spouse for 11 yrs he remarried. Found out that 1st marriage was not resolved. Would his present marriage be legal.

Legally, no way! He better get an atty real quick and see what he has to do before the law catches up with him and he has further problems.

I think it depends if your friend has tried to get in touch with the first spouse to get the divorce...I had a friend who tried for years and her first husband never responded to any of her attempts to the point of she didn't even know where he ended up. After 10 years of trying (and proof that she did try) she was granted divorce and able to remarry the guy she had been living with for the past 7 years. To this day, still doesn't know where the first guy is and she's back to living a normal life. Check with a lawyer and confirm what is/isn't legal.

Un-fortunately, this man has commited Bigamy . He is a Bigamist and it is against the Law in America. No it would not be legal, if the first marriage was not desloved. Being he has not seen his fist spouse, it could be she is dead. If he finds out that his first wife is dead then the second marriage is legal.

If you did not get a DIVORCE, you are still married to the first man. And yes the 2nd marriage is illegal and you would probably be consider a polygamist. You need a lawyer like yesterday.

Yes his present marriage is illegal. He is a bigamist and there is possible jail time involved. You must be divorced before you can remarry.

If he has not seen nor heard from his wife in 7 years...then he can legally say that his wife is legally dead..and can re-marry..At least that is the law in Texas..It may vary from state to state..Call your local court house to find out..

It depends on what state he is in. Either he is a poligamist and married to multiple women or the second marriage will be null and void because he is still married to the first women.

The answer is NO!!!! This is considered a type of Fraud, and legally, he can end up in a whole lot more trouble than just TWO angry wives!

Not if he is living in America. If he went to court and had her legally pronounced dead before he went and married another then it would of been legal.
