Well first ask him for the money and say if you don't I will sue you for it. If he gives you the money then and there then you dont' have to pay for a lawyer and court costs. Next time you loan out that kind of money you need to have a legal document saying that they borrowed the money and have a time line of when it will be payed back either in installments or all at once, and if not payed back then you have the right to sue them for said amount. And if they don't then it gives you more leeway on the situation.

Of course you can. The question is how you structured the loan. you might end up getting screwed and having a pissed off son at the same time.
