I was asked to take pictures of co workers to be displayed on a board at work.I used my own equipment, and was in the middle of completeing the assignment when someone entered a secure area and stole my camera and cell phone. The employer is a large metropolitan hospital.Do i have a right to make a claim against the hospital at the risk of my employment? Should they be insured for such losses? What if any are my options or can i just kiss my camera good by and take the loss? I filed a local police report and a report with hospital security. Two months after the incident the hospital installed keyed access security in the building.A similar system was in place at the time of the theft but apparently didnt deter the thief.

If you were asked to bring your camera to work as a direct part of your job, then the employer is responsible for articles stolen from a secure area.

You would find it very difficult to prove. You would have to prove the items were left in the car and could not have been stolen whilst the car was in your possesion. Also a service of the car may not include checking the glove box. So if the car had been rented out to another person prior to you reporting the missing items you would not be able to prove the next person to hire the car did not take the items. Finally you acknowledge yourself that the car was only "supposedly" serviced, even if the service should have included a check of the glove box this may not have happened allowing a future hirer of the car to have taken the items. The responsibility for the personal items left in the car was your own. You should have ensured their removal before returning the car.

My radio/recorder was stolen off my bus a few years ago, and my employer (the school system) never did a thing about it...Nor did the police...No options were avaliable for me, either...
Then last year we had our things in a gated storage lot, and were stolen...Did you know that you can file a report, but nothing happens?
I think you can kiss your camera and equipment good-bye...

If you have presented this question to your employer and are not getting good answers, consult with an attorney. That is your best legal advice. But on the common sense side of things, do you really want to sue your employer?

Depends on what your employers policy is. If in the contract that you signed or in the employees handbook that you were given it addressed this issue (schools forbid electronic items, cameras etc being brought on campus and it is stated in school handouts) and they are against it then they are not liable.

The law says that you are responsible for your own personal property. The only person accountable other than yourself is the theif.
