humans ARE animals. Some humans seem quite dumb though ;-)
among marine mammals it's either dolphins or killer whales, both active predators. whales just open their mouths which has got to require (much) less intelligence, even if there is a common ancestor for all three. Apart from marine mammals I had heard that the octopus was fairly smart, for example it can unscrew the cap from a bottle...
on the ground I'd say apes or monkeys. Of course cats / dogs / foxes / wolves can show a good deal of intelligence (hunting strategies, think about what another animal / human being may do) but they have no hands, not much of a language, cannot make tools, you name it.
does this help at all?

Yes we are animals. We are Primates....chimpanzees are our closest relatives. The DNA is amazingly similar.
Anyway....where intelligence is concerned, I would have to say the dolphin. They are highly intelligent and they communicate with the use of a very complex language which human beings are only just beginning to understand.

OCTOPUSES
they could open jars
make their way through mazes
unscrew a screw
escape from a net using a knife
trap crabs (prey) with some clever tricks that they learn
they have IQ in the range of 110 to 299
they are smarter than most other vertebrates including humans which leads many to think that they may be ET

Humans are animals of the family Hominidae, genus Homo and species sapiens
There are several criteria to determine the highest intelligence. The one I prefer is making sex without the need of reproduction which is applied by dolphins and bonobos (a variety of chimps) apart from human. Dolphins do it for joy. Bonobos do it for social status improvement. Humans do it for both.

Well, I may be showing a few declining brain cells, but here goes:
I think an Orca has a bigger brain than a human & a highly developed social structure, language, and such. Then I think the human brain is next...and after that *maybe* dolphin (not entirely sure on that one)
As for land animals.....I a bit more at a loss than ocean animals. Sorry. And again....don't quote me & research the facts to be sure!

Humans are animals.
But probably chimps. Chimp and Human infant development is exceedingly similiar for the first year or so.
It really depends on your guidelines. Dolphins can die by willing themselves to stop breathing. That's using your brain in a way humans can't, but not sure if it shows more "intelligence".
Likewise, birds can plot high-speed flight plans at a speed well beyond what we could do.
It really depends on what you are calling "intelligence".

Humans are not animals?
Why should I take you seriously when you offer a completely absurd contention right up front?
Of course we are animals. How else can we be defined?
Other than that I believe the answer is dolphins.
My reason for thinking this is that dolphins throughout the world appear to speak the same basic language. Which, in one regard, means they are MORE intelligent than we are...
and I'm sure THEY wouldn't be disturbed to be catagorized as animals...
