I work for a very small company (under 10 employees) - i have always been a good employee however in the last 6 months i have gotten divorced from a mentally ill spouse, moved 2 times, dealt with real estate and divorce lawyers, cared for a parent with cancer, tried to stay on top of my treatments for past cancer scare, and raise 2 kids that i have sole custody of. Sometimes I am distracted - do you blame me? Now he wants to talk to me tomorrow - Do I have rights?

Of course you have rights.

It often is not what happens to us, it's how we deal with it. Obviously you have alot to carry on your shoulders, it's human nature to vent and carry that baggage everywhere.
I encourage you to talk calmly with your boss, don't become defensive or abusive. Just like there are times at work you need to vent your frustrations, he may be doing alittle of the same with you.
Pay attention in this meeting. It could be a warning that you need to compose yourself professionally or it could be just a friendly, concerned meeting to help you emotionally.
Good luck with everything and keep a positive outlook. Negativity breeds negativity...

You've had a tough spell lately, and it looks like things may be getting worse, so you need a strategy.

What do you mean by "distracted"? Have you not done your job or not done it well? Unless you had an agreement with you manager before all of your personal issues began, your boss does not have to give you any leniency.

If you are unable to do your job well and take care of family and health issues at the same time, regardless of how bad a spell you've been through, it might be best for you to take a temporary leave of absence. It also might be good to see a therapist--your distraction could be due to a mild depression and medication might help or you might qualify for a medical leave.

Sorry you've had such a bad time of it lately. Your life has been pretty difficult--things won't always be this tough. Try to keep your job.

In most states in the US, you are hired as a "right to work" employee. Which basically means you or your employer can terminate your work relationship at any time without cause.

You need to learn how to separate work from other life. You may be getting fired tomorrow, or just being put on probabtion. It's time to clear up your act if that is the case and get focused.

As to your rights, you really don't have any. Just try to work it out.

You would think with all of that going on, he would have a little compassion. The sad part is, not alot of bosses do! There are no legal recourses that you have to use against him firing you (if he does) He hired you to do a job, if you cant, bad home situation or not, then he has the right to find someone who can. Sorry...

You really need to talk to an attorney to get an exact answer, but your employer has the rights also. He has the right for your undivided attention and get the work done for him paying you.

While I do not blame you for your problems, it may be a time for you to start looking for less demanding job, or ask him to give you a part-time status....

unfortunately, i don't think u do. while ur boss may sympathize with u, remember that he still has a company to run & he needs u to do the work he hired u for. maybe u should take some time off to regroup if u can afford to if not, then try to leave ur problems at home & concentrate on ur job at least until it's time to go.

Sucks to be you but no, you have no rights. If you worked at a larger company (50 or more), you would be entitled to time off under the FMLA - Family Medical Leave Act but your not..like I said..no rights.

its a tough situation you are in; and that's completely understandable, however; he has the right to have an employee that has her priorities set and that can balance work and stress.

sadly, no. you were hired to work, that's it. if your personal life, however traumatic or hectic it is, shouldn't interfere with your work performance or habits. once it does, then your boss has grounds to terminate you bcuz of that. not right, but that's life unfortunately.
