My brother takes care of his 2yr old daughter Mon-Fri and the mother takes her on the weekends. The mother is a welfare recipient that does not work, yet my brother pays for daycare because she will give him a hard time if he asks her to watch the baby. There is a rumor going around the neighborhood the girl lives in, that the baby is not his. My mother tried to get him to take a paternity test and he refuses. I told him to leave her alone from the moment I met her, as she is very ghetto and never works and he works and has a degree. (I think in a relationship, one should deal with like minded individuals.) Now he owns his own company and makes a very good living. Is there any way the mother can take my neice from him and then get an astronomical amount of child supprt? What does he need to do to ensure this does not happen?

Get a Lawyer,then take what ever advice he gives you
and put that on the back burner.Go to another then compare
notes and then choose wich one you`ll retain.Then do what
ever is nessasary.But you must block her from the court first!!!!!!

Ultimately if this does happen - I don't think it will be such a big deal. Because if they went to court over, it seems your brother would win. Generally in the decision of who gains custody over the kids, the court looks at if they have a job and can support the kids, where they live - if it's decent, etc...So I don't think there is anything to worry about. As long as the mom gets to see the kids from time to time, it should all work out. Really, it's probably better that he's paying for daycare, and has the little girl most of the time. From the sound of it, it doesn't seem the mother is a very good one - I get this not from the fact that she's on welfare, but rather that she does't have a job and seemingly could, and also that you stated she would throw a fit if he asked her to watch the kids. So I don't think there is too much to worry about.

The only way to ensure that she would never try to take custody from him is for him to have her sign her parental rights away. That, or bump her off. Otherwise, the issue of custody can ALWAYS be brought before the court by either party. And yes! If she were to win custody, she would be entitled to child support determined by how much he makes. That he seems more fit a parent than her won't make an open and shut case. Her being on welfare and not working won't be enough, though it may cause the court to force a paternity test. He'll need CONCRETE EVIDENCE of her being unfit. Testimony from other people won't work. He'll need drug tests, arrest records, or ther such documentation.

Unfortunately it sounds like your brother has made up his mind. Does he have custody? Does anyone? Is he on the birth certificate as the father? If he is on the birth certificate and the mother has custody they can go after him for child support. He would need to get a paternity test to get his name on the birth certificate and then fight for custody. If it isn't his after a paternity test then he will have to decide what he wants to do.

he needs to go and get court papers stating he has primary custody, i hate to say it but some women are trifeling and dont want to work, then they get pregnant just so they can have a man pay their way, even if they could care less about the child. please encourage him to get legal papers to protect himself and the child, from a money hungry person

He should file for sole custody. If she doesn't work or have a stable living condition, I see no reason why it would not be granted to him.

TELL HIM TO MAKE SURE HE KEEPS A COPY OF ALL HIS MONEY ORDERS ALL RECEIPTS.
. OR ELSE IT WILL BE HIS WORD AGAINST HERS AND IF THERE IS NO PROOF THAT HES PAYING SHE COULD GET HIM GOOD IN CHILD SUPPORT.
