If it is paid directly to you and you dont require her or someones help to make monetary decisions, then DLA is for you and you alone, to help you with your disability.I can see absolutely no reason that your wife could give as to why she should be entitled to part of this benefit. Best to speak to a disability aware solicitor - or a benefits aware one.

How in the world ex wife can entitle for you share in your disability??? living allowance? Only if you have kids and you need to pay child support then yeah.. but for her?? heck no way jose. make sure lawyer and judge knows it not right. taking some of my money and giving to my ex wife i wouldn't be able to live normal life. imight have to live on street or something.

They will take into consideration all the income of the family. There are different charts used to calculate the amount of child support, maintenance, and other things that are ordered to be paid. The disability income will be one factor in this calculation.

I would raise a dispute if she did get a share. that allowance is for your disability, not to keep her. Check with the benefits office asap.

There's a lot to be said for pre-nuptual agreements.
Any income you have is fair game in the Divorce Courts,
whether she gets it is a different matter.

They can garnish it from you if she is entitled to child support or alimony.

I am pretty sure she does...but the courts make the final decision, based on her and your income.
